1. Acceptance of Terms

Welcome to 1218.io ("Publisher", "we", "us", or "our"). These Terms of Service (including the End User License Agreement, collectively the "Terms") constitute a legally binding agreement between you ("User" or "you") and 1218.io concerning your access to our website and your use of our software products, including but not limited to Seer, PinStack, and Snapdown (collectively, the "Software" or "Service").

By downloading, installing, copying, accessing, purchasing a license key for, or using the Software, you confirm that you are at least 18 years old (or of legal age of majority in your jurisdiction; if under 18, using under the supervision and with the consent of a parent or legal guardian) and agree to be bound by these Terms. If you do not agree to these Terms, do not install or use the Software.

2. License Grant & Device Limits

Subject to your continuous compliance with these Terms, the Publisher grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software:

  • Device Count Licensing: The number of machines on which you may install and actively activate the Software is limited to the tier specified at purchase (e.g., "1 device", "3 devices", or "5 devices"). Installing or activating on more devices than authorized is not permitted.
  • Hardware Replacement: Device activations are bound to unique hardware environments. If you upgrade, repair, or replace your PC, our licensing system provides deactivation and migration mechanisms to transfer your seat to your new hardware within reasonable usage limits, which does not constitute a license transfer to a third party.
  • Permitted Use: Software licenses are granted solely for personal use or for internal business operations within your organization.

3. License Restrictions & Permitted Use

You agree that you will not, directly or indirectly:

  • Reverse engineer, decompile, disassemble, modify, adapt, translate, or create derivative works of the Software, except to the extent permitted by mandatory law;
  • Sublicense, rent, lease, lend, sell, resell, publicly share, or distribute the Software or license keys to any third party (except where explicitly authorized in writing as an authorized reseller), or operate the Software in multi-tenant environments without authorization; if a license key is found to be leaked, shared, resold without authorization, or subjected to abnormal high-frequency activation abuse, the Publisher reserves the right to blacklist and revoke the key without refund or liability;
  • Volume & Enterprise Licensing: Large-scale volume licensing for corporate or institutional customers (e.g., 100+ devices), custom deployments, or wholesale reseller agreements are governed by separate commercial purchase orders or enterprise agreements negotiated between the parties;
  • Virtualization & Multi-Tenant Clarification: Deploying a single license across public networks or multi-tenant hosting environments for concurrent sharing by unauthorized third parties is strictly prohibited; however, compliant internal use by an organization's personnel within standard Remote Desktop (RDP) or Virtual Desktop Infrastructure (VDI) environments is permitted, provided sufficient device seats or user licenses have been acquired to cover all deployed seats;
  • Code & Process Injection Restrictions: Execute or deploy unauthorized memory injection, DLL hijacking/injection, API runtime hooking, or dynamic tampering targeting the Seer host process for the purpose of circumventing license verification, disabling anti-piracy mechanisms, defeating digital rights management, or maliciously altering intended software behavior; standard operation of legitimate antivirus software, endpoint detection and response (EDR) solutions, OS accessibility tools, or OS-level diagnostic and debugging tools is expressly exempted;
  • Remove, obscure, or alter any copyright, trademark, or proprietary rights notices included in or with the Software;
  • Use the Software for any unlawful purpose or in violation of applicable laws and regulations.

4. Ownership & Intellectual Property

The Software is licensed, not sold. The Publisher and its licensors retain all right, title, and interest in and to the Software, including all related patents, copyrights, trade secrets, trademarks, and intellectual property rights. No title or ownership rights are transferred to you.

5. Billing, Payments & Merchant of Record

To provide reliable and secure payment processing for our global customers, online transactions on 1218.io are handled by an authorized Merchant of Record partner:

  • Payment Processing Partner & Compliance: Orders and payments are processed exclusively by Waffo Pancake. According to Waffo Pancake's public compliance statements, its billing platform adheres to PCI-DSS (Payment Card Industry Data Security Standard) Level 1 certification standards.
  • Card Data Protection: All payment card details are transmitted directly to Waffo Pancake's secure servers. 1218.io does not collect, process, or store full credit or debit card numbers or CVV codes on our servers.
  • Taxes and Currency: Prices displayed on the website are confirmed at final checkout. Depending on your country or state of residence, applicable sales tax, VAT, or GST will be calculated and collected by Waffo Pancake as required by tax authorities.
  • Microsoft Store Purchases: If you purchase the Software through the Microsoft Store, billing, currency processing, invoicing, and applicable taxes are administered exclusively by Microsoft Corporation under its commercial terms.

6. Order & Subscription Cancellation Policy

We believe in transparent and straightforward cancellation practices:

  • One-Time Orders: You may abandon or cancel an order at any time prior to completing the online checkout without incurring any charge.
  • Recurring Subscriptions (if applicable): If you subscribe to any recurring billing plan, you may cancel automatic renewal at any time via the billing management link provided in your Waffo receipt email, or by emailing cc.seer@gmail.com. Cancellation takes effect at the end of the current paid billing cycle, and no further renewals will be billed.

7. Refund Policy & Procedure

To balance consumer fairness with digital asset security, our refund policy operates on a "Try Before You Buy" evaluation model and accounts for the offline nature of our desktop licensing:

  • Comprehensive Free Trial: We provide a fully functional free trial prior to purchase. We strongly encourage all users to download and evaluate the Software in their specific operating system and hardware environment before purchasing a license.
  • Offline Licensing & Consummation of Digital Delivery: Seer and PinStack operate locally and function fully offline once activated. The Publisher cannot and does not remotely access, tamper with, or deactivate offline machines. Consequently, once a license key has been activated on any device, the digital content and license grant are deemed fully delivered and consumed. Pursuant to applicable statutory consumer regulations (including Directive 2011/83/EU Article 16(m) and equivalent digital goods provisions), you acknowledge and agree that voluntary activation constitutes performance of the contract and waiver of any statutory right of withdrawal or unconditional refund.
Scenario Eligibility Policy Terms
Unactivated License (Within 14 Days) Full Refund Within 14 days of purchase, if the license key has never been activated on any machine, you are eligible for an unconditional 100% refund.
Activated Offline License Generally Non-Refundable (Final Sale) Because a full free trial is provided prior to purchase and activated offline licenses cannot be remotely revoked, activated licenses are treated as Final Sales. In rare cases where an irremediable, critical software defect is diagnosed and confirmed by our technical support, a discretionary exception may be granted.
Revocation Upon Refund Immediate Invalidation If a refund is granted under an exception or billing error, the associated license key is permanently blacklisted and revoked. Continued use of the Software with a refunded key constitutes unauthorized copyright infringement.
Duplicate Charges / Billing Errors Full Refund Any accidental duplicate charges caused by checkout anomalies or gateway timeouts will be verified and refunded in full immediately.
Microsoft Store Purchases Governed by Microsoft Policy For licenses purchased through the Microsoft Store, refund requests and eligibility are governed exclusively by Microsoft's store refund policies and procedures. The Publisher cannot directly issue refunds through the Microsoft Store back office.
Purchases Beyond 14 Days Non-Refundable Orders placed more than 14 days prior to the request are strictly non-refundable.

How to Request a Refund

To request a refund, simply follow these steps:

  1. Send an email to our official support address: cc.seer@gmail.com;
  2. Include the subject line: "Refund Request - [Software Name]";
  3. Provide your Order ID / Transaction ID, the email used during checkout, and a brief description of the issue;
  4. Resolution SLA: We acknowledge and review all refund requests within 2 business days. Once approved, the refund is processed through Waffo Pancake back to your original payment method within 5–10 business days.

8. Updates & Lifecycle Policy

The Publisher may release bug fixes, enhancements, performance optimizations, or version upgrades at its discretion:

  • Definition of "Lifetime Updates": The term "Lifetime Updates" displayed on product purchase pages refers to the commercial product lifecycle (Product Lifecycle) of the Software—meaning that for as long as the Publisher actively develops, maintains, and distributes the major software product, licensed users are entitled to receive relevant updates, improvements, and bug fixes within the scope of their purchased tier. "Lifetime" does not refer to the natural lifespan of an individual human purchaser.
  • Scope of Updates: Routine bug fixes, maintenance releases, and minor version updates (Minor Updates) are provided free of charge. If the Publisher introduces a completely re-architected or independently developed major generation (Major Generation) in the future, the Publisher reserves the right to offer such major generations under separate upgrade terms or as standalone offerings.
  • Reservation of Development & Lifecycle Rights: The Publisher reserves the right to retire or sunset older software versions or discontinue ongoing development upon reasonable prior notice, particularly in the event of major underlying operating system changes, third-party technology deprecation, or significant commercial adjustments.

9. Third-Party Components, Proprietary Software & Open Source

  • Open Source Software Components: Certain components of the Software are provided under their respective open-source licenses. Where applicable, those licenses are included with the Software or listed in the third-party licensing notices. In the event of a conflict between these Terms and an open-source license applicable to a specific component, the open-source license shall govern for that component.
  • Commercial Proprietary Third-Party Components (Oracle Outside In Technology): Certain modules of the Software (such as Office document preview functionality) incorporate proprietary commercial software components licensed from third-party vendors, specifically Oracle Outside In Technology (OIT). These proprietary components are protected by copyright laws and trade secret laws, and all intellectual property rights remain exclusively with Oracle or its licensors. Users shall not decompile, reverse engineer, disassemble, or extract such proprietary components. Oracle and its licensors make no express or implied warranties regarding such proprietary components and disclaim all direct and indirect liability to the maximum extent permitted by applicable law.
  • Qt Libraries & LGPL Compliance: The Software may include libraries licensed under the GNU Lesser General Public License (LGPL), such as the Qt framework. The Publisher utilizes such components via dynamic linking. In accordance with LGPL requirements, users are entitled to re-link or replace such libraries with compatible versions compiled by themselves. Complete third-party notices and license details are available in the application documentation or accompanying files.

10. Official & Third-Party Plugins and Extensions

To support a wide range of file formats and custom workflows, Seer offers open extensibility and plugin architecture:

  • Distinction Between Official and Third-Party Plugins:
    • Official Plugins: Plugins bundled with Seer or officially published and signed by 1218.io, maintained by the Publisher under official quality and security standards;
    • Third-Party Plugins: Plugins developed, distributed, or maintained by community or third-party developers, which remain the sole and exclusive responsibility of their respective authors. The Publisher does not warrant, verify, or endorse third-party plugins, and no partnership, agency, joint venture, or employment relationship exists between the Publisher and third-party plugin authors.
  • Intellectual Property & Open Source Compliance: Third-party plugin developers must independently ensure that their code, algorithms, and dependencies comply with all applicable copyright laws and third-party software licenses (including, without limitation, reciprocal open-source licenses). If a third-party plugin infringes any intellectual property rights, misappropriates proprietary code, or breaches open-source licenses, all legal liability rests strictly and solely with the plugin author. The Publisher assumes zero joint or several liability; users install and run third-party plugins at their own risk.
  • Operational Risk & Disclaimer of Liability: Third-party plugins execute locally on user devices. To the fullest extent permitted by applicable law, the Publisher shall not be liable for any system instability, crashes, data loss or corruption, privacy leaks, security vulnerabilities, malware incidents, or performance degradations caused by third-party plugins.
  • Architectural Guidelines & Security Prohibitions:
    • Recommended Isolation Architecture: For system stability and security, we strongly recommend and advocate the "Out-of-Process Convert Architecture" or external execution models using standard process contracts. Running plugin helpers in dedicated child processes provides total memory isolation from the Seer host, prevents crash propagation, and preserves licensing boundaries;
    • Prohibition of Malicious In-Process Injection: Any unauthorized memory injection, DLL hijacking/injection, API runtime hooking, or dynamic tampering targeting the Seer host process for the purpose of circumventing licensing, bypassing anti-piracy measures, or tampering with core software behavior is strictly forbidden. Plugins employing such intrusive techniques are classified as unsafe, and the Publisher reserves the right to block such plugins via host security mechanisms.
  • Notice & Takedown: If any copyright holder believes that a plugin listed or referenced in community resources infringes their rights, they may send a notice to cc.seer@gmail.com. The Publisher will promptly review the notice and remove relevant links or directory references where appropriate.

11. Disclaimer, Backup Responsibility & Limitation of Liability

To the maximum extent permitted by applicable law:

  • As Is: The Software is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Local File Processing & User Backup Responsibility Disclaimer: Seer provides read-only rapid local preview of user files and is not a backup, archival, file recovery, or data preservation service (Seer is not a backup, archival, file recovery, or data preservation service). Users remain responsible for maintaining appropriate backups of their files and data (Users remain responsible for maintaining appropriate backups of their files and data). To the fullest extent permitted by applicable law, the Publisher assumes no liability for any file or data loss resulting from local filesystem errors, hardware failure, external environmental factors, or third-party decoding component anomalies.
  • Limitation of Liability & Cap: In no event shall the Publisher or its licensors be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, business interruption, or data). The Publisher's total cumulative liability for all claims arising out of these Terms shall not exceed the actual amount paid by you for the Software license in the 12 months preceding the claim.

12. Termination

These Terms remain in effect until terminated. Your license terminates automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the Software and uninstall all copies. Sections 3, 4, 9, 10, 11, and 13 survive termination.

13. Governing Law, Multilingual Precedence & Dispute Resolution

  • Governing Law: These Terms shall be governed by and construed in accordance with the laws applicable in the Publisher's jurisdiction, without giving effect to any conflict of law principles. Parties agree to attempt informal, good-faith resolution via email (cc.seer@gmail.com) prior to initiating formal proceedings.
  • Multilingual Version Precedence: These Terms and related policies are provided in multiple languages including English and Chinese. In the event of any discrepancy, ambiguity, or conflict of interpretation between language versions, the English version shall prevail and govern, and non-English translations are provided for convenience and reference only.
  • Notice of Material Terms Revisions: In the event of material revisions to these Terms that significantly affect core user rights or obligations, the Publisher will notify registered purchasers via the email address on file and maintain an archive of previous versions on the website. If you do not agree with material revisions, you may discontinue use of the Software.
